For qualified customers who participate in the Visible Upgrade Program, these terms and conditions supplement the Visible service Terms and Conditions and the Visible Privacy Policy.
Visible Upgrade Program. The Visible Upgrade Program is available to qualified customers who finance and activate an eligible iPhone.
Upgrade Program Eligibility. You may upgrade to a new eligible iPhone (“Upgrade Option”) if you meet the following requirements:
- Device Installment Payments to Affirm. You have paid Affirm at least 50% of the installment loan total for your existing iPhone (the “Original Installment Loan”).
- Good Standing. Your Visible wireless account is in good standing. Your account with Affirm is in good standing under the terms of your loan agreement.
- Physical Device Condition. Your existing Financed iPhone (“original Financed iPhone”) must be in good physical and operational condition, meaning that it (i) powers up and operates in a manner consistent with the original manufacturer’s specifications for both hardware and software, (ii) is free from liquid damage, (iii) does not have a cracked or broken screen, and (iv) has no physical damage to the housing, buttons and charging port.
- Authorized Repairs. If you decide to repair or seek a service replacement of the original Financed iPhone prior to exercising the Upgrade Option, you must use an Apple Authorized Service Provider.
Exercising your Upgrade Option. You must meet all of the following requirements in order to successfully exercise your Upgrade Option (steps 1-5 below, the “Upgrade Option Requirements”):
- Pay off 50% of your Original Installment Loan amount.
- Apply for and enter into a new 0% APR installment loan with Affirm (“New Installment Loan”). Conditions apply. Visit https://www.affirm.com/terms Applying for a New Installment Loan requires a new credit check. You must upgrade to the latest iPhone model available offered by Visible (“New Financed iPhone”).
- Activate the New Financed iPhone on a new or existing wireless service plan with Visible.
- Return your original Financed iPhone as directed by Visible. Your original Financed iPhone must be received by Visible within fourteen (14) days from the date your New Financed iPhone is shipped. Before you send back your original Financed iPhone, you must disable “Activation Lock”, “Find My iPhone”, remove your SIM card and delete any personal data or files. The device must be properly shipped to avoid damage during transit. The International Mobile Equipment Identifier (IMEI) of the device you return must match the device IMEI in Visible’s records.
- Complete your first installment payment on your New Installment Loan.
Termination of Original Installment Loan After Meeting Upgrade Option Requirements. When you have successfully met the Upgrade Option Requirements, Visible will pay the remaining balance on your original Installment Loan to Affirm on your behalf. You will make subsequent monthly payments to Affirm under the terms of your New Installment Loan.
If you do not meet the Upgrade Option Requirements, Visible will not pay off the original Installment Loan and you will continue to be responsible for any missed and/or remaining payments under the original Installment Loan in addition to your payment obligations under your New Installment Loan.
Lost or Stolen Device. If your original Financed iPhone has been lost or stolen you will not be eligible for the Upgrade Option.
Return of New, Upgraded Device After Exercising Upgrade Option. If you exercise the Upgrade Option and subsequently return your New Financed iPhone under the terms of Visible's Returns Policy, the original Financed iPhone that you returned as instructed by Visible will not be returned to you and the New Installment Loan associated with your New Financed iPhone will be terminated.
General
Subject to Availability. Upgrading to a new eligible iPhone is subject to its release and availability at the time you exercise your Upgrade Option.
Eligible iPhone. An eligible iPhone is an iPhone that Visible offers for sale.
Visible reserves the right to substitute, change, cancel or add to any part of these Upgrade Program Terms at any time.
Visible Upgrade Program eligibility and approval is not transferrable.
